Turning a fragmented Asian metro project record into Tribunal-ready delay and cost evidence

Situation: Disputes
Arbitration

Context

A 240 mUSD arbitration over a major metro construction project involved extensive delay, disruption and cost claims across multiple systems and workstreams.  The project record was highly fragmented, covering programme updates, access constraints, testing and commissioning, cost claims and competing expert analyses.

Key Takeaway

Our work distilled a complex and technical record into a clear delay and cost narrative.  It allowed the Tribunal to focus on the drivers of delay and substantiated quantum, while providing a structured framework for testing competing expert positions through reports, testimony and cross-examination.

Accuracy Role

Our experts imposed structure on the evidential record, focusing on the sequences and cost elements most relevant to entitlement.  Acting as both delay and quantum experts, we performed As-Planned versus As-Built, remaining-duration and critical-path analyses across key systems, while testing cost claims against contemporaneous records and reconciling them to source data. The analysis was developed to support expert reports, hearing preparation, oral testimony and cross-examination. The close collaboration of our delay and quantum teams enabled us to deliver robust and coherent insights.
