Public sector PPP under scrutiny in Canada

Situation: Disputes
Litigation

Context

Our client, a Quebec public entity, received claims for cost overruns and delays from the contractor on a PPP project. The public entity was seeking support in the form of an audit of (i) the changes made to the project and whether the process defined in the contract had been correctly applied and (ii) the strategy implemented by the controller/project manager to prevent any claims.

Key Takeaway

Our ability to summarise thousands of documents and eight years of history into an efficient 150-page report was instrumental. Our added value was twofold: (i) we were able to guarantee our findings were fully supported by documentation and (ii) we were able to analyse the available information accurately to provide a clear opinion in a short period of time.

Accuracy Role

We were engaged to explain and quantify the claims and determine why each one had arisen. Understanding each claim was a challenge, as they were specific and complex, involving highly technical construction matters that were discussed in various pieces of correspondence between the construction company and the representatives of the public entity.
