CONSTRUCTION MATTERS:

Project Advisory, Oil and Gas

Worked closely with a company heavily involved in oil and gas construction in the United States to develop project management policies and procedures, project controls tracking and monthly project and portfolio evaluations for all field projects. The new measures were implemented over a three year period, resulting in more accurate forecasting, better customer relationships, and higher profitability.

Project Advisory, Courthouse

Assisted the project team during the construction of a courthouse to monitor progress, prepare delay-related change orders, including preparation of multiple, sequential Time Impact Analyses (TIAs) and follow-on retrospective schedule analyses for certified claims. Findings were presented during mediation, and the matter was ultimately able to be settled.

Delay and Damages Analysis, Senior Living Facility

Performed a damages and delay analysis on behalf of the owner of a senior living facility in Colorado. Analyses included preparation of affirmative delay and damages claims against the contractor, as well as analysis and rebuttal of contractor claims. Issued multiple expert reports, witness statements and testimony during arbitration.

Delay and Damages Analysis, Road Work

Performed multiple analyses on behalf of a city in Minnesota and North Dakota to respond to contractor claims for delay and increased costs on a road development project. In both matters, findings were presented and the matters settled during mediation.

Delay and Damages Analysis, Stadium

Performed an analysis of increased costs due to delay and disruption on behalf of the structural steel contractor during the construction of an NFL football stadium. Analyses included calculation of increased costs due to delay and the resulting acceleration on a date-specific project. Performed an analysis of delays during the construction of a light rail line to aid the contractor in the preparation and negotiation of change orders with the owner. Analyses included review of past and current project schedules, acceleration plans, project documentation and discussions with the project team to determine the total duration of delay in multiple areas and causes of delay.

Claims Analysis, Airport

Assisted the construction manager of a large airport project to review the joint venture’s and its subcontractors’ claims and assist with settlement negotiations. Numerous project documents were reviewed, including project schedules, correspondence, cost documentation, and unapproved change order submissions. Multiple presentations on overall and specific claim issues were prepared and presented.

Claims Analysis, Bridge

Assisted the joint venture on a new bridge project to review and analyze claims by the steel supplier and its fabricator related to alleged changes in the design of the bridge. Analyses included assessment of the supplier’s cost quantification of the changes and a critique of the schedule delay analysis put forward by the supplier. Also assisted the joint venture in analyzing the causation position of the supplier.

Claims Analysis, Oil Refinery

Performed an analysis on behalf of the owner of an oil refinery related to claims by a civil contractor for delay and disruption during the expansion of the refinery. Reviewed and rebutted the contractor’s claims for acceleration, disruption, and delay as part of the preceding of an ICC Arbitration.

UTILITY AND POWER PLANT MATTERS:

Damages Analysis, Nuclear

Assisted numerous utilities with damage claims against the US Department of Energy regarding spent nuclear fuel storage issues. Analyzed least-cost strategies for storage of spent nuclear fuel. Analyzed past and future capital, operation and maintenance, storage and decommissioning costs. Analyzed accounting reports and compiled and analyzed detailed supporting accounting records (including invoices, checks, purchase orders, etc.). Analyzed the labor distribution report on internal labor charges and compared it to claimed work orders. Prepared exhibits and outlines for expert witness trial testimony. Reviewed opposing experts’ workpapers, and prepared deposition questions. Assisted utilities with settlement analyses.

Cost Analysis, Power Plant

Performed an analysis of cost overruns experienced by an electrical contractor on a 150-MW natural gas-powered electrical plant due to design changes and increased scope. Analysis included a review of project documentation and the calculation of productivity loss due to directed acceleration. Assisted in the preparation of an expert report.

Delay and Damages Analysis, Water Treatment Plan

Analyzed a delay and disruption claim submitted by a subcontractor to the general contractor of a water treatment plant. Analysis consisted of a review of the initial claim and supporting documentation, review of the general contractor documentation and additional non-party documentation, along with a time impact critical path analysis to isolate the magnitude of delays caused by each issue and quantification of the resulting economic damage experienced by the general contractor and subcontractor. Findings were presented during mediation.
