Reconciling factual delay evidence with probabilistic weather modelling in an offshore wind dispute

Situation : Différends
L'arbitrage

Contexte

A 100 mUSD offshore wind dispute in Northern Europe required complex interaction between factual delay evidence and probabilistic weather models, alongside evolving project scope and vessel-related impacts.

Principaux enseignements

The work provided a single framework for testing factual delay evidence against probabilistic weather modelling. It enabled the Tribunal to focus on model reliability, vessel impacts and entitlement, and supported clear expert testimony under examination, expert conferencing and cross-examination.

Rôle de précision

Our experts developed a coherent and highly granular delay analysis linking factual sequencing with statistical weather modelling. We refined the weather model, incorporated scope changes, quantified vessel knock-on effects and translated the results into P-factor and P50 comparables capable of being tested against the project record. The work supported expert reports, hearing preparation and Tribunal-facing analysis.
