A Canadian exploration and gold production company held exploration and mining licences in Central Asia and had begun operating a gold mine. It alleged that its investment had been expropriated following several State measures, including the failure to grant operational and financing approvals and the imposition of new taxes contrary to applicable agreements.
The analysis converted regulatory, financing and operational evidence into a mine-level damages framework. By anchoring the valuation in the asset’s real economic drivers and technical record, the Tribunal understood that damages were to be analyzed as the financial consequence of specific constraints, rather than as a detached model exercise.
