Contexte

A major real estate developer in Europe engaged a construction company as the main contractor to carry out the redevelopment and extension of an existing shopping centre. The project encountered execution difficulties, resulting in both cost overruns and delays of more than one year against the original schedule. In that context, the parties tried to reach an amicable resolution, but that process was later suspended, and court proceedings were initiated.

Accuracy was engaged by the real estate developer to identify the key issues on which the expert analysis should focus on. Our team reviewed the documents exchanged during the contractual expert phase and the conclusions reached by other experts. We also analysed contract variations, the contractor’s claims, and the technical arguments advanced by both parties on responsibility for the modified works. In parallel, we examined the available project records, including monthly reports, correspondence, photographs and site videos, in order to assess the extent of the critical delay and identify its likely causes.
