Yesterday, Giovanni Foti, Partner at Accuracy, took part in the roundtable “The L'arbitrage of the Future”, organised by A&O Shearman Italy and the Milan Chamber of Arbitration, focusing on the evolving landscape of dispute resolution.
During the discussion, Giovanni Foti highlighted how the role of technical experts has significantly evolved in both international arbitration and civil proceedings. Today, experts contribute beyond evidentiary analysis, playing an active role in case strategy, risk assessment, settlement dynamics and even the structuring of mediation processes.
As arbitration practices have matured, with established tools such as expert reports, document production and cross-examination, the expert’s role has expanded from delivering isolated technical opinions to providing structured, methodologically robust analyses. Increasingly, experts support legal teams throughout the entire lifecycle of disputes, often from the earliest stages.
The discussion also underscored the growing multidisciplinarity and technological sophistication of the profession. Modern expert teams combine expertise in quantum, delay analysis, valuation, forensic accounting and digital forensics, leveraging data analytics and advanced modelling to address complex datasets and reconstruct technical narratives.
Finally, the role of experts in negotiation dynamics was emphasised. Through expert meetings, joint statements and technical exchanges, experts contribute to clarifying issues, narrowing gaps between parties and, in many cases, facilitating early settlements.
From technical specialists to strategic advisors, experts have become a central component in the resolution of complex disputes.
