Our client, a government organisation, was overseeing the construction expansion of a steel plant facility that encountered numerous delays and disruption events. The contractor initiated ad hoc arbitration proceedings against our client seeking compensation for prolongation and other related costs as well as relief from liquidated damages. The amount in dispute was approximately USD 20m.
We were engaged to assess the losses suffered as a result of critical delays and contractor underperformance. Our experts were able to work in tandem to develop a coherent picture of the financial consequences of slow progress of works and the contractor’s financial shortfall.
We were appointed as independent experts to analyse the reasons for delays to the project completion and to conduct a review of the actual losses linked to the project’s critical delays. During the arbitration, our experts submitted expert reports addressing delay and quantum matters, and provided oral testimony before the arbitral tribunal during the hearings.
