Our client, the EPC contractor for an airport expansion (runway, apron, terminal), had its contract terminated by the owner after three years due to delays. We were appointed to prepare independent expert reports on delay and quantum for ICC Arbitration.
Our work ensured a robust delay and quantum case from the outset, facilitated expert agreements during conferencing and strengthened legal causation arguments.
We performed four separate delay analyses on contractual milestones using As-Planned vs As-Built windows analysis and agreed methodology with the opposing expert. We also uantified damage suffered by the EPC contractor and challenged their initial counterclaims, providing the tribunal with an independent assessment and a solid basis to assess legal causation.
