Ce fut le th\u00e8me central d'un panel perspicace lors de l'\u00e9v\u00e9nement \"Digital Antitrust\" de Concurrences sur la r\u00e9gulation du secteur num\u00e9rique, r\u00e9unissant des perspectives de l'UE, de la France et des \u00c9tats-Unis.<\/p>\n<p>Notre associ\u00e9e Pascale D\u00e9champs a rejoint Eshien Chong (Autorit\u00e9 de la concurrence), Olivier Fr\u00e9get (Fr\u00e9get Glaser &amp; Associ\u00e9s), et Luca Prete (Cour de justice de l'Union europ\u00e9enne) pour une discussion opportune mod\u00e9r\u00e9e par le professeur David Bosco (Aix-Marseille University). Les outils de concurrence ex ante et ex post ont chacun leurs forces et leurs limites ; ex post fonctionne bien pour les cartels mais est moins efficace pour les abus du march\u00e9 num\u00e9rique, o\u00f9 les mesures ex ante peuvent pr\u00e9venir des dommages irr\u00e9versibles.<\/p>\n<p>Elle a \u00e9galement \u00e9voqu\u00e9 la d\u00e9cision Apple ATT comme exemple d'une affaire bas\u00e9e sur un abus d'exploitation, sans qu'aucune injonction ne soit impos\u00e9e \u00e0 la fin.
